1) I, the customer hereby authorize NEXUS AUTO GLASS. ( hereinafter referred to as “Co.”) to provide the goods & services referenced in front of this document.
2) I authorize Co. & it’s employees to drive this vehicle (for testing or delivery) at my risk.
3) I agree that my replacement windshield, back-glass, or quarter-glass is warranted against defects in material for thirty (30) days & against water leaks, air noise for 3 months after installation. However, motorhomes, big-rigs, van conversion windows or any work on any custom vehicles or classics, or vehicles over 20 years old, are entirely & expressly excluded from this warranty. Furthermore, any notation of rust voids ANY and ALL warranties.
4) I agree that my replacement roll-up glass is warranted against defects in said glass for one year. There is no warranty for operation as Co. didn’t know the condition of the motor, regulator, locks, switches, fuses, relays, lift Brackets or any other components before they worked on the car. This includes operation of express up/down aka auto up/down aka anti-pinch features.
5) I agree that any glass or part that I provide or any used glass or used part that Co. provides has no warranty at all! Including, but not limited to breakage during or after installation, leakage, fit, =defroster operation, opening or closing operation. I agree to hold Co. harmless in the event of ANY malfunction of used components Co. provided or ANY component (new or used) that I provided.
6) I understand the manufacturer of a dealer item (power window motors, glass, other parts, etc) provides the warranty on the part. I understand that Co. only warrants the installation, for as long as I own the vehicle.
7) I agree & understand there will be no warranty on any parts from Co. that Co. did not install.
8) I agree there will be no warranty pertaining to the appearance of a rock chip repair, or against it spreading during the repair. If it spreads while I own my car, the Co. will apply the amount I paid for my chip repair(s) towards a new windshield that I will purchase only from Co. and have installed only by Co.
9) If I have a complaint or problem, I agree to bring my car to the shop location, at the time the Co. designates. Furthermore any claim of negligence made by me against Co. must be made before leaving premises.
10) I promise to pay for these goods & services immediately upon request from Co. I acknowledge that an express mechanic’s lien will be attached to the repaired car to secure the amount of repairs thereto.
11) I declare that I have left no valuables in my car, & I agree to hold Co. harmless for all losses to vehicle or articles therein in case of fire, theft, accident or other causes.
12) I agree that clean up of the broken glass in or on my car is a courtesy that is usually provided, however Co. is not obligated to perform that function. I also understand that because there are thousands of fragments of broken glass Co. can not guarantee that every single fragment will be removed from my car. Furthermore, I agree to hold Co. harmless for any injury or damage caused by small glass particles left in or on the car.
13) I agree that paint jobs that are aged, defective or not original can not be warranted against peeling, fading, flaking or bubbling. Use of chemical cleaners & tape is common & necessary. I agree to hold Co. harmless if these practices caused a problem on my car that has aged, defective or non-original paint.
14) I agree that many plastic trim pieces are brittle from age, weather or oxidation. I agree that Co. isn’t liable if these should break or become discolored.
15) I agree to a $50 service fee on all returned checks, & if the check is not satisfied within 30 days I am liable for 3 times the amount of the check. No less than $100 & up to $500 plus the amount of the check.
16) I agree, Co. has the right to refuse service to anyone & to request “cash only” in advance as the only form of payment & I agree that all forms of payment must be approved by Co. prior to starting work.
17.) Time when safe to drive: No less than 1 hour from time of windshield installation. *If I the customer do elect to drive car before this time, I do so at my own risk & acknowledge that I have been advised of passenger airbag ineffectiveness & I have been warned to wear seatbelts at all times! I have been advised of windshield dislodging if a collision or rollover occurs before the above time. I agree to hold NEXUS AUTO GLASS harmless for any & all losses or claims resulting from my premature operation.
18) I agree that if a court deems any part of this document to be unenforceable, all other sections shall remain valid and in force.
